NEWTON – The United State’s Attorneys Office said over the weekend a brutal beating last month in Newton is not a hate crime.

Former Maiden High School football standout Tommy Henry and two other suspects, Jarvis McCullough and Johnny Abernathy were arrested in the beating and torture of a homeless white male. Newton Police initially contacted the U.S. Attorney’s Office to help them determine if the crime constituted a hate crime.

The beating and torture included the victim being burned with a cigarette lighter. The incident stopped only after the victim made repeated requests to seek medical attention.

Henry, who dominated the high school gridiron in the Catawba Valley Athletic Conference, was attending a community college in Kansas and home for summer break. Henry was staying with his father in Newton.
